USACE Introduces New RRS Module
The U.S. Army Corps of Engineers (USACE) recently announced the launch of a new module within its Regulatory Request System (RRS) that allows users to self-verify that a pre-construction notification is not required for a proposed activity covered under a nationwide permit. This new module guides users through a series of questions about their proposed activity to determine whether notification to USACE is required. Questions are presented sequentially. If the information provided through the RRS indicates that the proposed activity qualifies for an existing nationwide permit without requiring a pre-construction notification, users will immediately receive correspondence.
Over the past few weeks, we have been testing and using the self-service module on projects and have developed a process that combines our Self-Certification memo, which documents how a project complies with all non-reporting requirements of the Nationwide Permitting Program, with the self-verified automated response from the RRS site as an appendix. This approach allows us to provide a clear, concise memo that includes official USACE correspondence. Project developers can share this documentation with lenders, buyers, EPCs, and permitting agencies to demonstrate project compliance with Section 404 of the Clean Water Act.
Please reach out to our experienced wetland staff with any questions or to discuss how your project may benefit from this new module on the RRS site.
